Location of Oswald at the Time of the Assassination Empty Location of Oswald at the Time of the Assassination

1.     Police Officer Marrion Baker's First Affidavit, 11.22.1963

As I entered the door I saw several people standing around. I asked these people where the stairs were. A man stepped forward and stated he was the building manager and that he would show me where the stairs were. I followed the man to the rear of the building and he said, "Let's take the elevator." The elevator was hung several floors up so we used the stairs instead. As we reached the third or fourth floor I saw a man walking away from the stairway. I called to that man and he turned around and came back toward me. The manager said, "I know that man, he works here." I then turned the man loose and went up to the top floor.  The man I saw was a white man approximately 30 years old, 5' 9", 165 pounds, dark hair and wearing a light brown jacket.

2.     FBI Report by Bookhout & Hosty, 11.22.1963 (dictated 11.23.1963)

Oswald stated that he went to lunch at approximately noon and he claimed he ate his lunch on the first floor in the lunchroom; however he went to the second floor where the Coca-Cola machine was located and obtained a bottle of Coca-Cola for his lunch. Oswald claimed to be on the first floor when President John F. Kennedy passed this building.

3.     London Free Press, 11.22.1963

As the presidential limousine sped to the hospital, the police dragnet went into action. Hicks said just about that time, Oswald apparently came out of the front door of the red-bricked warehouse. A policeman asked him where he was going. He said he wanted to see what the excitement was all about.

4.     Washington Post, 11.23.1963

"He apparently got out of the building during the time we were surrounding it," Curry said. As an officer rushed into the building Oswald rushed out. The policeman permitted him to pass after the building manager told the policeman that Oswald was an employee.  "He apparently lost himself in the crowd then," Curry added.

5.     The Dallas Morning News, 11.23.1963

He said Truly and an officer ran into the building. In a storage room on the first floor, the officer, gun drawn, spotted Oswald. "Does this man work here?" the officer reportedly asked Truly.

6.     New York Herald Tribune, 11.23.1963

Mr. Campbell said, "Shortly after the shooting we raced back into the building. We had been outside watching the parade. We saw him (Oswald) in a small storage room on the ground floor. Then we noticed he was gone.

7.     Report on Officer’s Duties by Marvin Johnson, (date unknown)

Officer Baker and the building manager then went to a stairway and started up the stairs to search the building. On about the 4th floor Officer Baker apprehended a man that was walking away from the stairway on that floor. Officer Baker started to search the man, but the building manager stated that the man was an employee of the company and was known to him. Officer Baker released the man and continued his search of the building. Officer Baker later identified Lee Harvey Oswald as the man seen on the 4th floor of the Texas Book Depository.

8.     FBI Report by Williams-Pinkston, 11.22.1963 (dictated 11.22.1963).

He then noticed a Dallas City Police officer wearing a motorcycle helmet and boots running toward the entrance of the depository building and he accompanied the officer into the front of the building. They saw no one there and he accompanied the officer immediately up the stairs to the second floor of the building, where the officer noticed a door and stepped through the door, gun in hand, and observed OSWALD in a snack bar there, apparently alone. This snack bar has no windows or doors facing the outside of the building, but is located almost in the center of the building. The officer pointed to OSWALD and asked if OSWALD was an employee of the company and he, TRULY, assured the officer that OSWALD was an employee. He and the officer then proceeded onto the roof of the building....

9.     Roy Truly Affidavit, 11.23.1963

I saw an officer break through the crowd and go into our building. I realized he didn't know anything about the building, so I ran in with him. The officer and I went through the shipping department to the freight elevator.  We then started up the stairway. We hit the second floor landing, the officer stuck his head into the lunch room area where there are coke and candy machines. Lee Oswald was in there. The officer had his gun on Oswald and asked me if he was an employee. I answered yes. We then went up the stairs to the 5th floor where we found the elevator open.

10.  FBI Teletype from Dallas to Washington, 11.23.1963

Truly was on sidewalk in front of his place of employment with practically all other employees from building when Kennedy was shot. He immediately accompanied a police officer into the building and up the stairs to the second floor, where they observed Oswald alone in the company snack bar. Snack bar in center of building, has no windows and was unusual place for anyone to be at that time. after search of building completed, Oswald could not be located.

11.  New York Times, 11.24.1963

The first officer to reach the six-story building, Lieut. Curry said, found Oswald among other persons in a lunchroom. He said the building manager identified Oswald as an employee of the book-distribution concern that used the building. Oswald was not questioned then.
When the main force of investigating officers reached the building, Oswald had left.

12.  Warren Commission Testimony of Harry D. Holmes, 4.2.1964.

Mr. Holmes: …he talked about this commotion and went out to see what it was about.

Mr. Belin: By the way, where did this policeman stop him when he was coming down the stairs at the Book Depository on the day of the shooting?
Mr. Holmes: He said it was in the vestibule.
Mr. Belin: He said he was in the vestibule?
Mr. Holmes: Or approaching the door to the vestibule. He was just coming, apparently, and I have never been in there myself. Apparently there is two sets of doors, and he had come out to this front part.
Mr. Belin: Did he state it was on what floor?
Mr. Holmes: First floor. The front entrance to the first floor.

Emphasis (mine) added.

I'll be highlighting the sequence of evidence (reports, testimony, etc.) showing the evolution of the Oswald-Officer Baker encounter and how it was moved to the the second floor next (either here or in a new thread). You can already see this beginning to happen above.

I'm doing all of this so I can have the facts (most of them anyway) in one spot. Right now, I'm having to page through my book to find some things. Perhaps this will be helpful for others as well.

Thanks for highlighting it, Stan. Some need it more than others. How anyone in their right mind can believe all this 2FE nonsense and take it as gospel is beyond me. I wish they'd wake up and smell the bullshit.

Location of Oswald at the Time of the Assassination Edmont10
Edmonton Journal 25/11/63

This can only be a reference to Eddie Piper who originally stated he spoke to Oswald at around 10 am - then changed it to midday in his next statement, before saying it was both during his WC appearance.

At the noon conversation, Piper claimed Oswald said he was going "up or out" (to eat lunch/watch the parade).

I think the 10 am conversation happened with Oswald but the noon conversation was really with Jack Dougherty - and that Piper did indeed escort Dougherty "up".
