For 24 hours the second floor lunch room encounter did not exist!
Wed 25 Oct 2017, 2:29 am
This started as a joint convo between Ed Ledoux and me on FB.
The first press report of the 2FLRE was on the 23rd at 13:50 hrs.
Dallas - The first suspicion of the slim, black-haired man was by a policeman who saw Oswald in the building lunchroom. The officer pulled a gun on Oswald, but when the manager said Oswald worked there, he was allowed to go. AP, 1:50 p.m., CST, Peggy Simpson
This is more than likely a FBI leak from Truly's affidavits. As by that time he was the only one making a mention of it. Fritz notes are written down after the fact (speaking of 'the deceased' in his notes i/e) so it bears no merit.
There is the DPD aff. from the 23rd and there are two FBI affidavits from the 23rd (although it says on one that it was dictated on the 22nd.). The one dictated on the 22nd to me comes from the FBI interviewing him inside the TSBD as Truly was there all day accommodating law enforcement officials. On the 23rd things were packaged nicely together to bring the 2flre fugezi forward.
Them there is Bookhout's/Hosty's report, from the 23rd, which on its second page displays the true sequence of events.

Did Capt Fritz ever say that Oswald told him he went up to the second floor? Did Oswald ever say he encountered a policeman on the second floor? If the second floor encounter really happened, then Oswald would know he couldn't lie about it and it seems so easy for him to say that after he finished his lunch he went up to the second floor to get a drink.

From Fritz's testimony:David Wimp wrote:Did Capt Fritz ever say that Oswald told him he went up to the second floor? Did Oswald ever say he encountered a policeman on the second floor? Mr. BALL. At that time didn't you know that one of your officers, Baker, had seen Oswald on the second floor?
Mr. FRITZ. They told me about that down at the bookstore; I believe Mr. Truly or someone told me about it, told me they had met him--I think he told me, person who told me about, I believe told me that they met him on the stairway, but our investigation shows that he actually saw him in a lunchroom, a little lunchroom where they were eating, and he held his gun on this man and Mr. Truly told him that he worked there, and the officer let him go.
Mr. BALL. Did you question Oswald about that?
Mr. FRITZ. Yes, sir; I asked him about that and he knew that the officer stopped him all right.
Mr. BALL. Did you ask him what he was doing in the lunchroom?
Mr. FRITZ. He said he was having his lunch. He had a cheese sandwich and a Coca-Cola.
Mr. BALL. Did he tell you he was up there to get a Coca-Cola?
Mr. FRITZ. He said he had a Coca-Cola.
----------------------
Police, including Fritz, used what was known as the Reid Technique. Part of that technique is in looking for psychological signs of lying in both verbal and body language.
The only time that Fritz verbally stumbled during his whole testimony was when the 20d floor lunch encounter was under discussion. If Fritz had been questioning Ball about this and Ball tripped over his own tongue in one area of questioning and one area only, Fritz would assume Ball was lying or hiding something. We should look at Fritz's testimony in that same light.
Oswald probably did go up for a coke to have with lunch. But that would have been before, not during or after the assassination. Mrs Reid was Truly's secretary. She had a personal interest in covering for her boss.
Note that in this testimony, Fritz claims he was told by Truly that the encounter happened on the stairs - but the police investigation of the matter proved it was actually in the 2nd floor lunchroom. So Fritz is expecting us to believe that Truly misremembered where the encounter happened, within a half hour of it happening???? And what the hell was the investigation into it? Ridiculous. The "investigation" consisted of concocting a fake time-line to frame Oswald.

The interesting response is, "he knew that the officer stopped him all right." It's like he is assuming that the issue is that Oswald would have known about it if he were confronted by a policeman. At any rate, he said nothing about where it happened. Ball doesn't seem inclined to flesh out Oswald's story to Fritz. Did he not notice that the issue had not been fully covered?

Of course he did. The WC lawyers were not idiots, even when the evidence of their questioning seems to suggest otherwise.David Wimp wrote:The interesting response is, "he knew that the officer stopped him all right."
